英国最高裁、英国特許法のもとで発明者は自然人であることを要すると判示 - UK Supreme Court confirms that an inventor under UK Patents Act must be a natural person, not AI.

2023年12月20日英国最高裁は、英国特許法の下では発明者は自然人であることを要する旨を判示した。発明申請者は、AIのみを発明者として申請していた。なお、同判決において裁判所は、本判決の争点はイギリス特許法の解釈に関するものであって、自律的AIによる技術開発が特許可能であるか否かに関するものではないことを付言している。

Dec 20, 2023, UK Supreme Court decided that an inventor under UK Patents Act 1977 must be a natural person. In the patent applications, the applicants filed a statement saying the inventor in the application was AI. In the decision, the Court added the decision is concerned about with the interpretation of UK Patents Act, but not concerned with whether technical advances generated by AI acting autonomously should be patentable.
